1. General

1.1 The owner of the online store sheseva.design (hereinafter referred to as the “Online Store” or “Website”) is Sheseva OÜ, 16722178 (hereinafter referred to as the “Seller”, “we” or “us”).

1.2 The Terms and Conditions (the “Terms”) apply when you as a Customer (hereinafter referred to as the “Customer” or “you”) place an order via sheseva.design and related pages (the “Website”). In addition to these terms and conditions, legal relationships arising from the purchase of products from the Online Store are governed by the laws of the Republic of Estonia.

With this agreement you also confirm that you have read and approved our Privacy Policy.

1.3 If the customer has created an account on the Website, the Customer undertakes to ensure that no one, except the Customer, uses the Customer’s log-in details. The Customer may not disclose their username or password to any person and shall ensure that any documentation with information about username and password is kept in such a way that unauthorized persons may not access the information. The Customer shall notify the Seller without delay if it may be suspected that any unauthorized person has obtained access to the Customer’s password. The Customer is responsible for all purchases made with the Customer’s log-in details if the Customer has not provided such notification.

1.4 The Website and all its content is owned by Sheseva OÜ or its licensors. This means that everything on the Website may not be copied or used without the prior written consent of Sheseva OÜ.

2. Orders

2.1 The product description in the Seller’s Website do not constitute as a binding offer on part of the Seller, but merely serve the purpose of submitting a binding offer by the Customer.

2.2 The Customer may submit the offer via the online order form integrated into the Seller's online store. In doing so, after having passed through the ordering process, and by clicking the button finalizing the order process, the Customer submits a legally binding offer of contract with regard to the goods and/or services contained in the shopping cart.

2.3 The Seller sends an order confirmation to the Customer via an e-mail, which constitutes as the receipt that the purchase has been completed. The Seller recommends to keep the confirmation and use it for any future contact with our customer service.

2.4 The Customer is responsible for ensuring that the information provided, such as email, name and address is correct and up to date. If the Customer has provided incorrect information, the Seller cannot be held responsible for any delays or other consequences that may occur.

2.5 The Seller reserves the right to refuse an order in the event of that the item ordered can not be delivered due to production issues or for any other reason. The Customer shall be notified at the earliest opportunity and money paid shall be refunded in full. The exact time it takes for the refund to be finalized depends of the payment method used by the Customer.

3. Prices and Payment

3.1 Unless otherwise stated in the Website product description, prices indicated are total prices including the statutory sales tax.

3.2 Delivery costs, where appropriate, will be indicated separately on the checkout page of the Online Store after Customer has entered the shipping address and chosen the delivery method.

3.3 Payment can be made using one of the methods offered on the checkout page of the Online Store.

3.4 If payment by bank transfer has been agreed upon, payment is due immediately after conclusion of the con­tract, unless the parties have arranged a later maturity date.

4. Shipping and Delivery

4.1 We ship to all European Union countries. If you are located outside of the European Union, please contact us to arrange a possible delivery.

4.2 The Customer can choose a DPD courier or a parcel terminal as the delivery method. The cost of the delivery depends of the destination country.

4.3 The Seller will ship the product within 7 business days after the payment has been received.

4.4 In case of Made-To-Order products, the exact time until shipping is indicated on product page as the Lead Time and depends of the current production backlog.

4.5 The delivery time depends on the destination country and the delivery method chosen by the Customer.

5. Right of Withdrawal

5.1 The Customer has a 14-day withdrawal period after receiving the goods. This means that the Customer has the right to cancel the purchase by notifying the Seller accordingly within 14 days from when the Customer or their representative received the product ordered (withdrawal period).

5.2 The right of withdrawal does not apply if the customer is a legal person.

5.3 If the Customer uses their right of withdrawal, the Customer is responsible for the condition of the product after the Customer has received the product and during the return shipping. The product shall be returned within 14 days from the date when Seller was notified of the withdrawal.

5.4 The products must be in their original packaging and all original labels must be attached to the products. If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics, and functioning of the goods, or if there are any signs of use or wear and tear, the Seller has the right to lower the amount returned in accordance with the decrease in the value of the goods.

5.5 The Customer shall register their return via email to returns@sheseva.com, specifying their name, order reference and name of the product in the message. After registration the Customer will receive an email containing instructions and address details for returning the package. Customer should not attempt to make a return before contacting the Seller.

5.6 The Customer is responsible for the transport risk and shipping cost for the return. Please note that the return must be sent as a traceable shipment. We suggest the Customer to save the tracking number and proof of postage until Seller has received the returned goods.

5.7 After the Seller has received and processed the returned goods, the Seller will make a refund to the Customer. All refunds will be made using the same method of payment the Customer used to purchase the product(s) unless otherwise agreed upon.

5.8 The Seller can not offer the right of return or exchange of custom/special made orders.

5.9 The Seller has the right to withdraw from the sale if the list price of the goods in the Online Store was significantly lower than the actual list price of the goods due to an error.

6. Warranty and Complaints

6.1 The Customer must make a complaint of a defective Product to Seller within a reasonable time after the defect was discovered. If the complaint is made within two (2) months after the defect was discovered it is always made on due date. After three (3) years the Customer has lost his/her right to make a complaint, provided that no warranty states otherwise.

6.2 The right to file a complaint applies to products which are defective according to applicable consumer protection legislation. Any Customer who wishes to assert their right to file a complaint for any product ordered, shall contact the Seller, as soon as possible after discovering the defect, via e-mail to claims@sheseva.com

6.3 If the Customer and the Seller cannot resolve the dispute by agreement, the Customer can contact the Consumer Disputes Committee or use the European Union’s online dispute resolution platform.

7. Force Majeure

The Seller shall be exempt from damages and other measures if the performance of the agreement is prevented or delayed by any circumstance beyond our control, e.g. extreme weather, new / amended legislation, absent permits, war, fire, flood, labor market disturbances, technical problems, sabotage, unfavorable transport, terrorist attacks, changed governmental orders as well delays in the service by sub-suppliers due to circumstances set forth above. The Seller shall inform the Customer accordingly if any such circumstances should arise, and if the situation has lasted more than six weeks, both the Customer and the Seller have the rights to cancel the purchase with immediate effect.

8. Changes to the Terms & Conditions

The Seller may make changes to the Terms of Conditions from time to time. When these changes are made, Seller will make a new copy of the Terms and Conditions available on its website.
